Necessary but flawed

Josh Breaker Rolfe talks to Lamprini Gyftokosta (Director of Artificial Intelligence and Human Rights at Homo Digitalis) about the EU AI Act. Josh notes that Gytfokosta questions its effectiveness and implementation, but that "believes that the EU AI Act is necessary but flawed." Major enforceability issues, difficult to interpret and suitability for protecting fundamental digital rights are all issues Lamprini raises. The golden ticket

And here I thought we were getting past the lawyer/non lawyer culture battles in legal. Far be it for me to tell anyone who to hire, but William Garcia's first comment is one that really annoyed me. He said, "For my team, practice innovation team, I have only hired people who are law school graduates. And the reason for that is our internal client base. ... The partners want somebody who has that golden ticket, that bar exam ... it jumps over the 'they don't understand what we do' [problem]." While not true of every individual, that mindset places people with the exact same training in roles who will make assumptions because they do know how things are done. Even William seems to recognize that, "I think when you talk to senior management, when you talk to the partners about the new cadre of skills sets that come in, one of the challenges [is] a comment you hear a lot-they don't understand what we do-[but] that can be good. You want someone to look at things 90 degrees off and say, 'why do we do it?'" I guess he doesn't need that enough to hire those without a golden ticket. Rob Kerr has it right, "We're looking for those people that aren't afraid to ask, 'what if? [Or] I wonder ...'" One of the best project managers I ever had was from outside legal and asked 'why?' and 'what if ?' constantly. It made the project better because the lawyers were forced to explain and justify why it was done that way. When they couldn't new and innovative ways were found to do things. And kudos to Aubrey Bishai who went outside legal to hire a former high school principal. Many things that are new to legal are initially filled from outside, the initial CIOs, CMOs, CISOs, and now roles related to data science and artificial intelligence. Golden ticket? Ba humbug. Doug Austin was inspired by Arve Hjalmar Holmen and now I think I'm inspired by Doug to run the same experiment. (Stay tuned for that!) You may remember the news story where Arve Hjalmar Holmen asked ChatGPT to tell him about himself and the AI gave back all kinds of crazy stuff - that he was sentenced to 21 years in prison because he murdered two of his children, attempted to murder his third son, etc. Doug turned to ChatGPT's Deep Research module to see what AI would say bout him.
